Catastrophic Injury Attorney in Indiana
Over 30 Years Representing Injured People Throughout Indiana
A catastrophic injury can change a person’s mobility, communication, employment, independence, and need for daily assistance. The financial consequences often extend beyond emergency care to rehabilitation, future medical care, adaptive equipment, home modifications, and loss of earning capacity.
We examine how the accident happened, who may be responsible, what insurance applies, and how the injury is expected to affect the injured person and family. For over 30 years, Shaw Law has represented people injured across Indiana.
Call (260) 777-7777 to discuss the injury and the next steps for evaluating a potential claim.
What Indiana Law Calls a Catastrophic Injury
Indiana’s criminal code defines a catastrophic injury as bodily injury so severe that it significantly impairs a person’s ability to live independently for at least one year. Statutory examples include blindness, deafness, paralysis, and intellectual disability. This definition applies to criminal sentencing. It isn’t a universal medical definition or the only measure of whether an injury is life-changing or supports a civil claim.
Other serious conditions may include a traumatic brain injury, a spinal cord injury, amputation, severe burns, loss of hearing or sight, or permanent cognitive or physical impairment. Whether an injured person has a civil claim depends on the cause, evidence of fault, and resulting losses.
Potential settings for these claims include:
- Car and commercial truck accidents
- Dangerous conditions on business property
- Construction and workplace incidents
- Defective products
- Other incidents involving negligent conduct
We handle cases involving brain injuries, vehicle and semi-truck accidents, construction accidents, products liability, work injuries, and premises liability. Premises liability may arise when a person or business controlling a property fails to address an unsafe condition.
A Severe Injury Claim Must Account for Future Losses
A claim may need to address far more than existing medical bills and missed paychecks. Depending on the evidence, recoverable losses can include ongoing treatment, rehabilitation, attendant care, adaptive equipment, pain, reduced independence, and diminished earning capacity.
Proving these losses may require medical evidence, employment history, accident records, and documentation of the person’s functional limitations and anticipated needs. Insurers may dispute fault or focus on costs already incurred, making it important to preserve medical, employment, property, and accident evidence.
How We Handle a Catastrophic Injury Claim
We manage insurance communications, investigations, negotiations, and personal injury lawsuits so clients can focus on their medical needs. Our review begins with how the accident occurred, the injury’s current effects, possible responsible parties, and any evidence that needs immediate attention.
Relevant evidence may include:
- Accident reports, photographs, and available video
- Witness names and contact information
- Medical records, bills, and treatment information
- Employment records and income documentation
- Insurance policies and insurer correspondence
- Evidence concerning the property, vehicle, or product involved
After analyzing liability and documenting damages, we can negotiate with insurers. When appropriate, the process may also include filing a lawsuit, discovery (the formal exchange of evidence), mediation, testimony, and trial. Jeff “JJ” Shaw has taken dozens of cases to jury trial, but the right path depends on the facts of each claim.
Clear Case Information for Clients & Families
Our EZ Case app provides access to case status, estimated case value, estimated completion date, and completed and remaining steps. Clients and involved family members can follow the case while treatment and recovery continue.
If the injured person is hospitalized, cognitively impaired, or unable to manage communications, a family member or legal representative can contact us. Our attorneys can also meet clients at home or in the hospital at no charge.
Premises Liability & Serious Accident Experience Across Indiana
Our work includes injuries caused by dangerous conditions on business property, motor vehicle crashes, and commercial vehicle accidents. We examine who controlled the property or vehicle, how the incident occurred, and which insurance policies or other sources of compensation may apply.
An Indiana catastrophic injury lawyer can assess a claim when an injury causes permanent impairment, extensive rehabilitation, prolonged hospitalization, an inability to return to work, or a continuing need for assistance. We prepare supported claims for negotiation and pursue litigation when the circumstances warrant it.
When to Request a Catastrophic Injury Evaluation
Seek legal guidance before signing a release or accepting an insurer’s proposal. Once accepted, a settlement generally resolves the covered claim, even if later treatment, care needs, or limitations cost more than expected.
Gather what’s available without delaying a consultation:
- Accident or incident reports
- Photographs, videos, and witness details
- Medical records and bills
- Insurance letters and emails
- Employment and wage records
- Notes about changes in mobility, work, communication, and daily activities
Missing documents shouldn’t stop you from calling. The first conversation can cover what happened, the current medical situation, available information, and practical next steps.
Discuss Your Injury With Our Indiana Legal Team
Our experience with premises liability and serious accident claims allows us to examine both immediate losses and the injury’s long-term effects. Through the EZ Case app, clients can also track key information as their claims progress.
We offer personal injury consultations and handle these cases on a contingency fee basis. Attorney fees aren’t owed unless we recover compensation for the client.
