Indiana’s Foreseeability Standard in Negligent Security Cases

Indiana negligent security claims turn on two legal concepts: duty of care and foreseeability. Under Goodwin v. Yeakle’s Sports Bar and Grill, Inc. (2016), 62 N.E.3d 384, Indiana courts approach foreseeability at the duty stage as a general threshold inquiry. The question isn’t whether the property owner could have predicted the specific attack that occurred, but whether the broad class of persons present and the general type of harm were foreseeable.

Duty Levels & Invitee Status

Indiana law recognizes two levels of duty. A general duty to protect invitees from harm applies across commercial premises. A heightened specific duty arises when facts show a known probability or likelihood of harm, per Rogers v. Martin (2016), 63 N.E.3d 316. Customers and patrons invited onto business property for a commercial purpose are invitees, and they’re owed the highest duty of care under Indiana law.

When foreseeability is factually intertwined with the duty question, the case may become a mixed question of law and fact. Disputed facts go to the fact-finder. The ultimate duty question stays with the court, consistent with Rhodes v. Wright (2004) and Helmchen v. White Hen Pantry (1997). A visitor’s status as an invitee or licensee is also a court determination under Winfrey v. NLMP, Inc. (2012).
